Coalition Executive Director Ryan Triplette applauds the New Hampshire State Government for passing S.B. 210, legislation that will protect innovation, customer choice, and competition in the software licensing market.
Concord, N.H. – Last week, New Hampshire Governor Chris Sununu signed into law Senate Bill 210 (S.B. 210), the Fair Software Licensing bill passed overwhelmingly by both chambers of the state legislature.
Some legacy software providers impose terms and conditions that dictate which cloud vendor state government agencies can use, resulting in lock-in to that vendor’s ecosystem. S.B. 210, sponsored by Sens. Sharon Carson, Rebecca Perkins Kwoka, Regina Birdsell, and Senate President Jeb Bradley, will prohibit software contracts entered into by a state agency from restricting the ability of the agency to choose the hardware or cloud environment that best meets its needs. State-level legislation on fair software licensing is a crucial step forward in enabling customer choice in the cloud and protecting taxpayers’ dollars from waste and abuse.

Carson, Perkins Kwoka, Birdsell, and Senate President Bradley for introducing this necessary legislation,” said Executive Director Ryan Triplette. “Unfair software licensing practices, such as the limited use of products across hardware, restrict customers’ freedom to make their own cloud service decisions. This bill will ensure the state government is unencumbered by restrictive software licenses and result in lower costs and increased services for New Hampshire agencies and taxpayers alike. We hope that other states will see the benefits of fair software licensing policies and follow suit.”

- Costs should be reduced through the efficient use of hardware
- Freedom from retaliation for choice of cloud service
- Avoiding customer lock-in through interoperable directory software
- Equal treatment for software licensing fees in the cloud
- Permitted uses of software should be reliable and predictable
- Licenses should cover reasonably expected software uses
