WASHINGTON, D.C. – Today, the Coalition for Fair Software Licensing (CFSL) Executive Director Ryan Triplette released the following statement in response to the United Kingdom (UK) Competition Markets Authority (CMA) Cloud Inquiry Group’s interim working papers on its investigation into the supply of public cloud infrastructure services in the UK. In its Licensing working paper, the CMA notes its emerging views that “Microsoft’s licensing practices may affect customers’ choice of cloud provider.”
“Every study to date that reviews Microsoft’s restrictive licensing practices reaches the same conclusion: Microsoft wields significant power over the legacy software market, which they use to engage in self-preferencing behavior that harms customers.
“The Competition and Markets Authority similarly outlines the ‘significant market power’ that Microsoft likely holds across a range of core software products and technical costs associated with an ‘asymmetry of integrations’ with their identity and access management services – an increasingly important consideration for customers in light of recent cyber events over the past year. These findings validate the serious concerns raised by customers worldwide about Microsoft’s ability to use restrictive licensing terms to favor their products and services over others – harming both competition and customer choice. Microsoft’s business model uses its customers’ reliance on its legacy software to drive Azure sales.
