“Any inquiry into cloud computing in the U.S. would be incomplete without a closer look at Microsoft’s anticompetitive software licensing and its impacts on customers.”
WASHINGTON, D.C. – Today, the Coalition for Fair Software (CFSL) requested the Federal Trade Commission (FTC) open an investigation into Microsoft’s anticompetitive software licensing practices. The request comes as part of the Coalition’s response to the FTC’s Request for Information on the business practices in cloud computing that could impact competition and data security.
“Microsoft has a proven history of leveraging its dominance in one market to gain a foothold and extinguish competition in another. Today the software giant is using that same playbook to exploit customers’ dependence on its desktop operating system, server, and productivity software to force customers to use Azure and other products in the Microsoft ecosystem,” Coalition Executive Director Ryan Triplette said.
Nearly three decades ago, the Justice Department found Microsoft guilty of violating U.S. antitrust law for tying its Internet Explorer to its desktop operating system. Today, Microsoft ties numerous products to Windows, Office, and Azure. In the Coalition’s public comment, Triplette details how Microsoft’s software licensing practices – restricting Bring Your Own License (BYOL) practices, discriminatory licensing, and tying – reduce customer choice, healthy competition, and cybersecurity in the cloud.
“We are asking the FTC to open an investigation into Microsoft’s anticompetitive restrictive software licensing practices,” Triplette continued. “Any inquiry into cloud computing in the U.S. would be incomplete without a closer look at Microsoft’s anticompetitive software licensing and its impacts on customers.”
In recent months, Microsoft has faced four complaints from European regulators, which are now pending before the European Commission. The German Federal Cartel Office has also initiated an investigation. Microsoft has responded with minor policy changes that do not address customer concerns.
