WASHINGTON, D.C. – Today, the Coalition for Fair Software Licensing (CFSL) reiterated its call for industry stakeholders to protect customer choice and flexibility in the cloud, one year after introducing the Principles of Fair Software Licensing to North America.
In a new open letter to industry, CFSL Executive Director Ryan Triplette encouraged customers, software providers, cloud service providers, and other industry stakeholders to publicly support the Principles. The Principles – backed by 90 percent of cloud decision makers and regarded as the gold standard in Europe – offer a framework for software licensing to protect freedom in the cloud while ensuring continued growth, adoption, and diversification of cloud services.
Over the course of the past year, the real-world consequences of restrictive licensing have taken shape in the form of large-scale cyber attacks impairing U.S. government agencies. In light of these developments, the adoption of Principles is essential to preserving and ensuring cyber agility, fostering innovation, and protecting consumer choice.
“The promise of the cloud has long been that of efficiency – in cost, delivery, and security. The Coalition for Fair Software Licensing was formed to ensure that the complexities of software licensing do not undermine that promise,” Triplette wrote in the open letter. “We are working to create a positive path forward of accountability and transparency for providers, customers, and all other industry stakeholders alike.”
Cloud computing is an essential part of succeeding in today’s economy. As software customers seek to unlock new innovations in the cloud, many continue to face contractual and financial barriers to the adoption of alternative cloud providers. These practices put innovation, cybersecurity, and digital transformation at risk.
“To date, customers have had to navigate these challenges alone – but are increasingly working together to highlight the ripple effect of these concocted barriers to the cloud of throughout the economy,” Triplette continued. “The Coalition and its members are part of a growing number of organizations calling for the support and adoption of the well-established Principles of Fair Software Licensing.”
Since introducing the Principles to North America one year ago, the Coalition has been working with its members and industry partners to advocate for greater transparency and choice in the cloud. The issue of restrictive licensing continues to gain momentum among customers and policymakers in the U.S.
In May 2023, the Coalition commended the Senate Committee on Homeland Security and Government Affairs for favorably reporting out of committee the Strengthening Agency Management and Oversight of Software Assets (SAMOSA) Act, bipartisan legislation requiring all U.S. federal agencies to conduct a comprehensive assessment of their respective software licensing contracts. In July 2023, the House Oversight Committee then made the promising and crucial step of unanimously voting to approve the bill for debate on the House floor.
States legislatures throughout the U.S. – including Massachusetts, Arizona, Iowa, Rhode Island, New Hampshire, and New Jersey – have advanced legislation promoting fair software licensing, procurement flexibility, and better taxpayer stewardship. As the Coalition calls on the industry to publicly support the Principles, it also encourages U.S. lawmakers to continue prioritizing fair software licensing for government customers.
