WASHINGTON, D.C. – On Thursday, August 1, 2024, CFSL Executive Director Ryan Triplette presented before the U.S. Federal Trade Commission (FTC) during the agency’s open commission meeting. Ryan highlighted the Coalition’s public comment to the FTC’s Request for Information (RFI) on the business practices in cloud computing that could impact competition and data security and called on the FTC to continue the good work of the cloud computing RFI and investigate Microsoft’s licensing practices. Her full remarks are included below.
“On behalf of the Coalition for Fair Licensing Software, thank you for the opportunity to participate in today’s open session. Our members include technology providers and customers of products and services that support policy-based changes to software licensing practices to ensure greater customer choice, innovation, and security in the cloud.
“The Coalition submitted public comments to the FTC’s Request for Information regarding cloud computing business practices in 2023. Our comment focused on Microsoft’s restrictive software licensing practices and how they utilize their dominant position and customer dependencies in key software sectors to limit competition throughout the cloud stack by locking customers within their ecosystem.
“Their tactics include first, stifling choice. Microsoft makes it cost prohibitive to use its must-have products, refuses to provide critical security updates, and does not provide product upgrades on alternative cloud providers, which effectively forces consumers into Azure.
“Second, adding restrictive policies. Despite recognizing the validity of complaints, Microsoft has failed to make global changes to address customer concerns, and instead, has added even more restrictions limiting customers’ ability to use competing clouds.
“And third, tying of products and discounts. Microsoft has leveraged customer dependencies on business essential software and priced out competing software services by tying an increasing number of products and services to its dominant productivity suite and conditioning discounts on the adoption of the Azure ecosystem.
“This conduct is causing wide-ranging harm from higher customer costs, including wasted taxpayer dollars, to decreased customer technology redundancy and resiliency. Globally, Microsoft faces growing scrutiny from regulators in the UK, the EU, and other regions. We encourage the FTC to further the good work of its cloud computing RFI and investigate Microsoft’s licensing practices. Thank you very much.”
