WASHINGTON, D.C. – Today, the Coalition for Fair Software (CFSL) Executive Director Ryan Triplette released the following statement in response to the U.K. communications regulator Ofcom’s final report on the U.K. public cloud infrastructure services market, which included significant discussion of the impact of unfair software licensing, and its referral of the market to the Competition and Markets Authority (CMA) for further investigation.
“Unfair licensing warps competition in the cloud by limiting choice, interoperability, innovation, and cybersecurity. The ripple effect of restrictive licensing is felt not only at the cloud infrastructure level but throughout the cloud stack.”
“We appreciate the significant attention that Ofcom made in its report to understand the effects of current software licensing practices – particularly those of Microsoft – on customer cloud adoption. We are encouraged that the Competition & Markets Authority recognizes the concerns that Ofcom has about software licensing, and we now urge them to continue expanding their purview and investigate the impact these restrictive practices have both on customers and competition.”
Ofcom first began its investigation of the U.K. cloud infrastructure in September 2022. In April 2023, Ofcom released its interim report with a dedicated chapter of significant concerns regarding Microsoft’s software licensing practices. In its final findings released today, the regulator outlines concerns of stakeholders that Microsoft leverages ancillary market dependencies and penalizes customers that use rival cloud providers through higher costs, reduced availability of security updates, and more.
Microsoft has faced increasing scrutiny for its licensing practices in the U.S. as well as Europe. Earlier this year, the U.S. Federal Trade Commission (FTC) issued a Request for Information (RFI) on the business practices in cloud computing that could impact competition and data security. In advance of the deadline for submissions, the FTC hosted a discussion entitled “Cloud Computing: Taking Stock and Looking Ahead,” during which a number of experts – notably, Frederic Jenny of ESSEC Business School in Paris and Steven Weber of the UC Berkeley School of Information – voiced concerns about the anticompetitive impact of Microsoft’s current software licensing practices. The Coalition echoed these concerns in our public comment, requesting that the FTC open an investigation into Microsoft’s software licensing practices.
